ORDER
28.02.2024 Heard Mr. J.U.N.M. Laskar, learned counsel for the petitioner and also heard Mr. P.S. Lahkar, learned Additional Public Prosecutor, Assam, appearing for the State respondent.
¶2This application under Section 482 Cr.P.C. is preferred by the petitioner, namely, Page No.# 2/2 Shreya Paul for quashing the FIR dated 16.10.2017 of Karimganj P.S. Case No.953/2017, under Section 354B/315/34 IPC. It is to be noted here that the above noted case has been registered on the basis of an FIR lodged by one Protyay Das on 16.10.2017.
¶3Mr. Laskar, learned counsel for the petitioner submits that upon the said FIR, the Officer-in-Charge, Karimganj P.S. having registered a Case No.953/2017, under Section 354B/315/34 IPC carried out investigation, which culminated in returning the case in final report due to insufficient evidence, being Final Report No.67/2023, dated 28.02.2023. Mr. Laskar has produced a copy of the F.R. before the Court, and further submits that in the meantime, the informant also suffered demise.
¶4Since the case has already been returned in F.R. due to insufficient evidence after investigation of the case and since the informant also suffered demise, in the meantime, this petition becomes infructuous and accordingly, the same stands closed.
¶5Copy of the F.R. produced before this Court by Mr. Laskar, learned counsel for the petitioner, shall be part of the record. Comparing Assistant Sd/- Robin Phukan JUDGE
