Heard Mr. Rubul Pathak, Deputy Manager, Oriental Insurance Company Ltd.

¶2The respondent no.1/claimant, namely, Sima Dey @ Sima Nag is present.

¶3Both the parties have jointly submitted that an award of Rs.14,09,936/- (Rupees fourteen lakh nine thousand nine hundred thirty six only) was passed vide order and award dated 04.02.2023, passed by the learned Member, MACT, Golaghat in MAC Case No.138/2017.

¶4It is jointly submitted that at the pre-settlement, the parties have negotiated settlement at a sum of Rs.13,00,000/- (Rupees thirteen lakh only) would satisfy the said award in full and final settlement of all the claims of the respondents.

¶5Accordingly, the matter is settled on compromise in terms of the pre-settlement/compromise slip for the National Lok Adalat, which is made as a part of record.

¶6Both the parties shall put their signature in the pre-settlement compromise slip as token of acceptance for the settlement.

¶7Accordingly, the Oriental Insurance Co. Ltd. shall deposit the settlement amount in favour of the respondent no.1 before the Registry of this Page No.# 3/3 Court within a period of 30 (thirty) days from the date of this settlement order, failing which the amount shall carry interest @ 9% per annum till such deposit is made.

¶8Out of the settlement amount, 30% of the said amount be kept in a fixed deposit account for 3 (three) years in favour of the respondent no.1 and the balance amount shall be paid to the respondent no.1 on satisfaction of her identity.

¶9On furnishing proof of the deposit of the entire settlement amount, the Registry shall release the statutory deposit made by the appellant.
