Judgment
ORDER Date : 06.09.2024
Heard Mr. N. Anand, learned counsel for the applicant and Mr. K. Jain, learned counsel representing Mr. S.C. Keyal, learned Special Public Prosecutor, NCB for the opposite party.
¶2The instant interlocutory application is preferred seeking correction of typographical error appearing in the accompanying bail application, B.A. no. 1868/2024. It is averred that in the cause-title and the prayer portion of the accompanying bail application, B.A. no. Page No. 2/2 1868/2024, it has been inadvertently mentioned as 'Sections 21[b][ii][C]/29/35/54/66/68 of the Narcotic Drugs and Psychotropic Substances [NDPS] Act, 1985' instead 'Sections 20[b][ii] [C]/29/35/54/66/68 of the NDPS Act, 1985'.
¶3The learned counsel for the opposite party has submitted that as the error appears to be inadvertent typographical error, he has no objection if the correction is allowed.
¶4As it transpires that the error is an inadvertent typographical error, the instant interlocutory application is allowed. Accordingly, in the cause-title and in the prayer portion of the accompanying bail application, B.A. no. 1864/2024, the penal provision is to be read as 'Sections 20[b][ii][C]/29/35/54/ 66/68 of the NDPS Act, 1985' instead of 'Sections 21[b][ii] [C]/29/35/54/66/68 of the Narcotic Drugs and Psychotropic Substances [NDPS] Act, 1985'.
