– B E F O R E – HON'BLE THE CHIEF JUSTICE MR. VIJAY BISHNOI HON'BLE MR. JUSTICE KARDAK ETE 31-05-2024

(Vijay Bishnoi, C.J.) This review petition is filed by the review petitioner seeking review of the order dated 13.03.2023 passed by the Division Bench of this Court in WA 54/2023 and WA 47/2023. The Division Bench of this Court passed the order dated 13.03.2023 after taking into consideration the submissions made on behalf of the appellant (review petitioner herein) that the controversy raised in the appeal stands covered by the order dated 10.03.2023 passed by a Coordinate Bench of this Court in WA 87/2023 and the appeal (WA 47/2023) be decided in the light of the order dated 10.03.2023. Learned counsel appearing for the respondents did not oppose the prayer made on behalf of the appellant and the Division Bench, on the basis of the submissions made on behalf of the appellant, disposed of the writ appeal in the light of the order dated 10.03.2023 passed by the Coordinate Bench of this Court in WA 87/2023. It appears that against the order dated 13.03.2023, the review petitioner has approached the Hon'ble Supreme Court by way of filing Leave to Appeal, Page No.# 3/3 which has been dismissed as withdrawn by granting liberty to the review petitioner to approach this Court by filing a review petition in respect of their rights of renewal. Pursuant to that, the present review petition has been filed. Having heard the learned counsel for the review petitioner and after taking into consideration the fact that in the writ petition filed by the review petitioner challenging the Catering Policy 2017, no prayer was made to issue a direction to the respondents to renew their vending licences, and also taking into consideration the fact that there is no provision for renewal of Catering Policy 2017, coupled with the fact that the order dated 13.03.2023 was passed on the basis of the submissions made on behalf of the review petitioner/appellant, we do not find any case for reviewing the order dated

13.03.2023 passed in WA 54/2023 and WA 47/2023. Hence, the review petition is dismissed.
