¶2This is an application under Section 483 of the BNSS, 2023 praying for grant of regular bail to the petitioner Lutfar Rahman who was arrested in connection with Tezpur P.S. Case No.453/2024, registered under Sections 309(4) of the BNS, 2023.

¶3On the day of occurrence, in an ATM teller, one Jeherul Islam took the ATM card of the informant and did not return it. Instead of returning the same, Jeherul Islam ran away and tried to board in a waiting Swift Dzire car. The unknown boys were already sitting in the said car.

¶4The petitioner has already spent 45 days in judicial custody.

¶5I have heard the learned counsel of both sides.

¶6This Court is of the opinion that the petitioner Lutfar Rahman does not deserve to be detained in custody for a further period of time. Accordingly, his bail application is allowed.

¶7The petitioner Lutfar Rahman who was arrested in connection with Tezpur P.S. Case No.453/2024, registered under Sections 309(4) of the BNS, 2023, is allowed to go on bail of ₹25,000/- with a surety of like amount to the satisfaction of the learned Chief Judicial Magistrate, Sonitpur, Tezpur. The bail application is disposed of accordingly.
