The State of Assam v. Mrigen Haloi

ORDER Date : 30.08.2024 Heard Mr. M. Phukan, learned Additional Public Prosecutor for the State of Assam and also heard Mr. D. Gagai, learned counsel for the respondent.

¶2This application has been filed praying for modification of the order dated 27.08.2024 passed by this Court in I.A.(Crl.)/784/2024, arising out of Criminal Appeal No.263/2024.

¶3In the said order, the judgment dated 22.07.2024 passed by the learned Special Judge, Assam in Special Case No.05/2021 was stayed, whereas sentenced imposed upon the Page No.# 2/2 respondent should have been stayed.

¶4I have considered the submissions made by the learned counsel of both the sides, the prayer of the learned Additional Public Prosecutor has the support of law therefore, the said order stands modified accordingly. The Sentence imposed upon Mrigen Haloi shall only be suspended till disposal of the appeal, not the entire judgment passed in Special Case No.05/2021.

¶5With the aforesaid correction, the I.A. stands disposed of.
