Heard Mr. R Islam, learned counsel for the petitioner and Mr. R J Baruah, learned Additional Public Prosecutor, Assam. This application has been filed under Section 483 of the BNSS, 2023 for grant of regular bail, by the petitioner, namely, Azgar Ali @ Azgor Ali Mondol, who was arrested in Page No.# 2/2 connection with Hatigaon P.S. Case No. 134/2024. The allegation brought by the informant against the petitioner is that on the day of occurrence, two boys came in a motorcycle and snatched her gold chain from her neck. Police arrested the present petitioner, who is 19 years old. The petitioner has admitted his guilt before the Police. Mr. Baruah has submitted from the Case Diary that the petitioner is a habitual offender and the stolen gold chain is yet to be recovered. On the other hand, Mr. Islam has submitted that the petitioner has already undergone 40 [forty] days in custody. I have considered the submissions made by the learned counsel of both sides. Considering the period of detention already undergone by the petitioner, this court is of the opinion that the petitioner does not deserve to be detained in custody for further period of time. Hence, the prayer for bail of the petitioner is allowed. Accordingly, it is hereby directed that the petitioner, Azgar Ali @ Azgor Ali Mondol, who was arrested in connection with Hatigaon P.S. Case No. 134/2024, shall be released on bail of Rs.25,000/- with one surety of like amount to the satisfaction of the learned Chief Judicial Magistrate, Kamrup (M), Guwahati. The bail application is disposed of. Return the Case Diary.
