Mr. J. Laskar, learned counsel for the petitioner, after having argued the matter for a considerable period of time; submits that he may be permitted to withdraw this writ petition with a liberty to approach the appellate authority i.e. the Government in the Department of School Education by way of preferring an appeal by invoking the provisions of Section 14 of the Assam Education (Provincialization of Services of Teachers and Re-organization of Educational Institutions) Act, 2017, against the action on the part of the State Level Scrutiny Committee(SLSC) in recommending the name of the respondent No. 7 for provincialization of her services in Bithor Chengmari M.E. Madrassa. Page No.# 3/3

Prayer is accepted.

The writ petition accordingly stands dismissed with liberty reserved to the petitioner to approach the appellate authority under the provisions of Section 14 of the Assam Education (Provincialization of Services of Teachers and Re-organization of Educational Institutions) Act, 2017, staking a claim for provincialization of his services and in the event of filing of any such appeal by the petitioner, herein; the appellate authority shall give its due consideration and dispose of the same after hearing all parties who would be affected by the said decision.
