¶1Heard learned counsel Mr. D. Thaosen for the petitioner Hemanta Boro.

¶2The petitioner has filed this application under Section 482 of the BNSS, 2023 with prayer for pre-arrest bail as he is apprehending arrest in connection with Page No.# 2/3 Mushalpur P. S. Case No. 90/2024 under Sections 336(3)/340(2)/341(4) of the BNS.

¶3Heard Ms. N. Das, learned Additional Public Prosecutor, Assam for the respondent State.

¶4The FIR unfolds that a fake document along with the official pad of the Cabinet minister/MLA U.G. Brahma was circulated. The informant received a fake document which was circulated through WhatsApp and when the informant verified the document, it was learnt that the document was fake.

¶5Learned Additional Public Prosecutor has submitted that there are incriminating materials in the case diary that the petitioner is involved in manipulating the document.

¶6I have scrutinized the Case Diary. Indeed there are incriminating materials in the case diary against the petitioner.

¶7At this stage, there appears to be no justified ground to extend the privilege of anticipatory bail to the petitioner considering the facts and circumstances of the case.

¶8Hence, Petition stands rejected at this stage.
