Heard Mr. D. Choudhury, learned counsel appearing for the petitioners as well as Mr. K. K. Das, learned Additional Public Prosecutor for the state of Assam.

¶2This is application under Section 482 of the BNSS, 2023 praying for grant of pre-arrest bail to the petitioners in connection with Bijni P.S. Case No. 121/2024.

¶3A minor boy was in love with a major girl. Both of them also had physical relationship. The families of the girl and the boy decided that whenever the boy will attained majority, his marriage will be solemnized with the girl.

¶4Thereafter, the boy started to avoid the girl. Ultimately, she committed suicide. The present two petitioners are the parents of the said boy.

¶5I have considered the submissions made by the learned counsels of both sides.

¶6There are no sufficient materials against the two petitioners in the case diary. Therefore, they do not deserve to be detained in custody.

¶7It is hereby directed that in the event of arrest in connection with Bijni P.S. Case No. 121/2024, the petitioners, namely, 1. Goutam Kr. Saha and 2. Jhumki Saha shall be released on bail of Rs. 20,000/- each with a surety of like amount to the satisfaction of the arresting authority.

¶8Both the petitioners shall cooperate with the investigation as and when called for. Page No.# 3/3 With the aforesaid direction the bail application stands disposed of. The CD shall be returned. JUDGE Comparing Assistant
