22/10/2024 Heard Mr. N Uddin, learned counsel for the petitioner and Ms. S Bora Hazarika, learned Additional Public Prosecutor, Assam for the State respondent. The petitioner, namely, Sarfas Hussain @ Sarfaj Ali, has filed this application under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023, seeking pre-arrest bail apprehending his arrest in Bilasipara P.S. Case No. 204/2024 registered under Sections 123/64(1) read with Section 6 of POCSO Act. On instruction of the petitioner, Mr. Uddin, learned counsel is not pressing this pre-arrest bail application to which Ms. S Bora Hazarika, learned Additional Public Prosecutor, Assam has no objection. Accordingly, this pre-arrest bail application, being not pressed, stands dismissed. Ms. S Bora Hazarika, learned Additional Public Prosecutor, Assam shall return the case diary to the concerned Police Station forthwith.
