04/10/2024 Heard Mr. I A Hazarika, learned counsel for the petitioner and Mr. R R Kaushik, learned Additional Public Prosecutor, Assam. The petitioner, namely, Shyamal Bora, son of Pradip Bora, has filed this application under Section 482 of BNSS, 2023 seeking pre-arrest bail apprehending his arrest in Basistha P.S. Case No. 174/2024 registered under Sections 379/34 IPC read with Section 11(1)(d) of Prevention of Cruelty to Page No.# 2/2 Animal Act, 1960, read with Sections 13(1)/16 of Assam Cattle preservation (Amendment) Act, 2021 corresponding to G.R. No. 1613/2024. During the deliberation of the matter, Mr. R R Kaushik, learned Additional Public Prosecutor, Assam, on instruction submitted that police after investigation of said Basistha P.S. Case No. 174/2024 has already submitted the charge-sheet on 26.06.2024 vide Charge-Sheet No. 324/2024. In view of the above, the petitioner shall approach the appropriate Court for his regular bail in said Basistha P.S. Case No. 174/2024. With the above observation and direction, this pre-arrest bail application stands disposed of.
