Heard Mrs. B. Gogoi, learned counsel appearing for the petitioner. Also heard Mr. D.P. Goswami, learned Additional Public Prosecutor appearing for the State. This is an application filed under Section 438 Cr.P.C., praying for pre-arrest bail by the petitioner, namely, Jaikhalang Hajowary, in connection with Page No.# 2/2 Kazigaon P.S. Case No. 58/2023(corresponding to G.R. No. 552/2023), registered under Section 323/353/427/34 IPC r/w Section 34/35/51 of Assam Forest Regulation Act. 1891. Mr. Goswami, learned Additional Public Prosecutor submits that in this case, charge-sheet has already been submitted vide C.S. No. 110/2023 dated

30.04.2023. It has been submitted by the learned counsel for the petitioner that interim protection has already been granted to the petitioner by this Court vide order dated 29.08.2023. In view of above, the present petition is disposed of with a direction to the petitioner to appear before the learned court below within 10 days from today and if any bail application is filed, the same will be considered by the learned trial court in accordance with law.
