Judgment

ORDER

23.09.2024 Mr. H.A. Sarkar, learned counsel appears for the petitioner, while Mr. P. Hazarika, learned counsel appears on behalf of Mrs. R.B. Bora, learned counsel for the BTC. Ms. U. Das, learned counsel appears for the respondent No.1.

¶2Mr. H.A. Sarkar, learned counsel for the petitioner prays that he may be allowed to withdraw the writ petition with liberty to file afresh.

¶3On perusing the writ petition, this Court finds that there is no document showing that an NIT had been issued for settlement of the Katajhar Ghoramar Hat for the year 2024-25, though a settlement of the said market had been made with the petitioner for the period 01.07.2024 to 30.06.2024. The above Page No.# 3/3 does not seem to be proper.

¶4In any event, as the petitioner has prayed for withdrawal of the writ petition with liberty to file afresh, the said prayer is allowed.

¶5The writ petition is accordingly dismissed as withdrawn, with liberty as prayed for.
