¶3The said case has been registered on the basis of one FIR lodged by one Susanta Banik, on 03.08.2023. ¶5On the other hand, Mr. Borthakur, learned Additional Public Prosecutor has produced the case diary before this Court and submits that the empty Truck was recovered from the Silchar, but the loaded items are yet to be recovered. Mr. Borthakur further submits that the I.O. has collected sufficient incriminating materials against the accused and the co-accused are yet to be arrested and therefore, it is contended to dismiss the petition.
¶6Having heard the submissions of learned Advocates of both sides, I have carefully gone through the petition and the documents placed on record and also perused the Case Diary with the assistance of Mr. Borthakur, learned Additional Public Prosecutor. Page No.# 3/3
¶7It appears that the accused has been arrested in this case on
04.08.2023 and since then, he has been languishing in jail hazoot. Further, it appears from the case diary that the I.O. has collected sufficient incriminating materials against the accused and the co-accused are yet to be arrested and the consignment loaded in the vehicle also not yet been recovered.
¶8In view of above, this Court is of the view that this is not a fit case where the privilege of bail can be extended to the accused.
