ORDER Date : 22.10.2024

¶1Heard Mr. N. Gogoi and Mr. P. Bordoloi, learned counsel for the petitioner. Also heard Mr. R. R. Kaushik, learned Additional Public prosecutor for the State of Assam.

¶2This is an application under Section 482 of the Bharatiya Nagarik Suraksha Sanhita

(BNSS), 2023, praying for pre arrest bail in respect of Manja P.S. Case No.21/2024.

¶3On 07.08.2024, a Bolero Pick Up truck was carrying bamboo and was travelling towards Manja. The Bolero Pickup truck was stopped by three persons travelling in Wagonr car without any registration number.

¶4Those three persons demanded a sum of Rs.1,00,000/- from the driver of the Bolero Pickup truck. Therefore, the driver informed the owner of the truck. The owner was also provided with QR Code for UPI payment.

¶5Accordingly, the owner paid the total amount of Rs.70,000/-.

¶6The money was credited into the account of Sri. Saret Hanse and thereafter the Bolero Pickup truck was released.

¶7Police arrested two persons, namely, Saret Hanse and Welson Terang.

¶8Mr. Gogoi submits that the present petitioner was not present in the place of occurrence on that day rather he was at Diphu doing his business.

¶9Mr. Gogoi further submits that the petitioner Philipson Tisso was also not present at the place of occurrence. Page No.# 3/3

¶10Mr. Bordoloi submits that the petitioner Mirlong Bey is not associated with the said offence and Police is searching for him without any reason.

¶11I have also gone through the Case Diary.

¶12The arrested person Welson Terang has stated before Police that the present two petitioners were also involved in the said offence.

¶13I have considered the submissions made by learned counsel for both the sides.

¶14The third person is yet to be arrested. Therefore entertaining pre-arrest bail to the present petitioners could not be justified at this stage.

¶15Therefore, the pre-arrest bail prayers made by the present petitioners are rejected.

¶16Case Diary shall be returned.

¶17Both the bail applications stands disposed of.
