Dipshikha Hazarika and Anr v. The State of Assam

Heard Ms. P. Borah, learned counsel appearing for the petitioners as well as Mr. R.J. Page No.# 2/2 Baruah, learned Additional Public Prosecutor appearing for the state of Assam.

¶2This is an application under Section 482 of the BNSS, 2023 praying for grant of pre-arrest bail to the petitioner in respect of Duliajan P.S. Case No.150/2024.

¶3Ms. P. Borah submits that the petitioner, Smt. Dipshikha Hazarika and therefore, this application in respect of her has become infructuous. Mr. Borah further submits that the petitioner, Karuna Kanta Gogoi is also in judicial custody in respect of other cases.

¶4The allegations brought against the petitioners is that the petitioner No. 1, Smt. Dipshikha Hazarika, being the wife of Karuna Kanta Gogoi, was a Bank Mitra in the Bank of Maharashtra Branch, Duliajan. Many people took loan from that bank with the help of Dipshikah Hazarika and they paid the installment amount through Dipshikah Hazarika and this Dipshikah Hazarika did not pay the amount to the bank. Rather, she misappropriated the said money. The case diary reveals that her husband, Karuna Kanta Gogoi is also involved alongwith Dipshikha Hazarika in the case.

¶5Considering the aforesaid facts, this anticipatory bail application is not found to be satisfactory.

¶6Accordingly, the bail application of the petitioner is rejected and disposed of. The CD shall be returned.
