ORDER
23.09.2024
Heard Mr. A. Rahman, learned counsel for the petitioner. Also heard Mr. B. Sarma, learned Additional Public Prosecutor. This is an application filed under Section 482 of BNSS praying for pre-arrest bail by the petitioner, namely, Jahan Uddin Sk, in connection with PRC Case No. 3291/2022 (arising out of Golakganj PS Case No.30/2022) Page No.# 2/2 registered under Section 379 of IPC R/W Section 11(I)(a)(b)(d) of the Prevention of Cruelty to Animal Act, r/w Section 13(1) of Assam Cattle Preservation Act. It is submitted by the learned counsel for the petitioner that police never visited his house where he is very much available during investigation but he has no knowledge regarding pendency of the case. However, he was shown as absconder in the charge-sheet. Learned Additional Public Prosecutor, on the other hand, submits that though charge-sheet has been laid showing him as absconder, summons was issued to the accused petitioner as such the petitioner may approach before the trial court seeking regular bail. I have considered the submissions made by the learned counsel for the parties. In view of the above, the petitioner is directed to appear before the trial court and in the event of filing any bail application, the trial court will consider the matter in accordance with law. Accordingly, the bail application stands disposed of.
