¶1It appears that this matter was listed today with a remark for dismissal in the Cause List since there was no representation on behalf of the petitioner when the matter was last called on 19.06.2024.

¶2Today when the matter is called Ms. A. Parasar appears on behalf of the petitioner. Ms. G. Hazarika, learned Standing Counsel, Revenue & Disaster Page No.# 3/3 Management and Mr. M. Goswami, learned Government Advocate for the State respondent and Ms. B. Sharma, learned CGC are present.

¶3Ms. G. Hazarika, learned Standing Counsel, Revenue & Disaster Management submits that the ex-gratia payment of Rs. 5 lakhs as sought for in the instant writ petition has already been sanctioned by the sanctioning authority in Revenue & Disaster Management Department. She further produced a communication dated 25.06.2024 which is kept on record and marked as 'X' which indicates that budget allotment of Rs. 5 lakhs for making payment of ex-gratia grant in respect of Late Nil Bahadur Khanal (petitioner's son) has been released with an online budget No. 05_HAM/GAD/001_2024_25(1)_11 dated

25.06.2024 in connection with the instant writ petition.

¶4Mr. N. Goswami, learned Government Advocate appearing for respondent No. 6 submits that the aforesaid sanctioned order has been sent by the District Administration only yesterday.

¶5In view of the aforesaid sanction, this Court is of the concerned view that this writ petition can be disposed of by directing the respondent No. 6 to release the sanctioned payment of ex-gratia grant to the petitioner within a period of 2 months from receipt of the sanctioned letter.

¶6Let a certified copy of this Court order be also furnished to the concerned respondent authorities by the petitioner. The writ petition stands disposed of.
