Heard Ms. S R Kalita, learned counsel for the petitioner and Mr. R J Baruah, learned Additional Public Prosecutor, Assam. This is an application filed under section 482 of the BNSS,2023 praying for pre-arrest bail by the petitioner, namely, Smti. Sabita Boro, in connection with Goreswar P.S. Case No. 51/2024. The deceased Fwisali Boro was married to Sri Swmkhwr Boro in the year, 2015. On 25.08.2024, the said Fwisali Boro was died. The father of the deceased woman lodged an FIR before the Police alleging that her husband and Page No.# 2/2 his family members had physically and mentally harassed the deceased. The Case Diary reveals that there were disputes between the husband and wife and the family members of the husband were pressing for divorce. Therefore, the deceased consumed poison and died. The present petitioner is the sister of the husband of the deceased. I have considered the submission made by the learned counsel of both sides. Since there are no sufficient materials in the case diary against the present petitioner to justify her detention, her pre-arrest bail is allowed. It is hereby directed that in the event of arrest of the petitioner, Sabita Boro, in connection with Goreswar P.S. Case No. 51/2024, the arresting authority shall release her on bail of Rs.25,000/- with one surety of like amount to the satisfaction of the arresting authority. The petitioner is directed to appear before the Investigating Officer within next [10] days without fail. The bail application is disposed of. Return the Case Diary.
