Heard Mr. A K Ahmed, learned counsel for the petitioner and Mr. R J Baruah, learned Additional Public Prosecutor, Assam. This is an application filed under section 482 of the BNSS,2023 praying for pre-arrest bail by the petitioner, namely, Jahanara Khatun, in connection with Manikpur P.S. Case No. 115/2024. 19 [nineteen] years old Basir Ali gave Rs.4,000/- to Rafiqul Islam as loan. Basir Ali asked Rafiqul Islam several times to return the money. On 16.08.2024, Rafiqul Islam called Basir Ali to Page No.# 2/2 his house for returning the money. When Basir Ali reached the house of Rafiqul Islam, he was attacked by Rafiqul Islam and his family members. Rafiqul Islam stabbed Basir Ali with sharp weapon. The Case Diary reveals that when Rafiqul Islam caused those cut injuries to Basir Ali, the present petitioner, being his wife, was holding Basir Ali from behind. Basir Ali sustained grievous injuries. I have considered the submission made by the learned counsel of both sides. There are sufficient incriminating materials against the present petitioner in the case diary. Therefore, the present petitioner is not entitled to the privilege of pre-arrest bail. Hence, the bail application is rejected. Accordingly, the present bail application is dismissed and disposed of. Case diary shall be returned.
