Case no.
WP(C) 5772/2013

Judgment

ORDER Date : 01.02.2024

Heard Mr. A. K. Purkayastha, learned counsel for the petitioner. Also heard Ms. S. Kemprai, learned standing counsel for the KAAC authorities. It is seen from the order sheet that on 24.10.2019, Mr. Purkayastha had informed this Court that the petitioner had expired during the pendency of the writ petition. Thereafter, the family of the petitioner has not taken any steps for having the legal heirs substituted in the present proceedings, which demonstrate that they are no longer interested to proceed with the matter. Accordingly, there being no one to press the issues arising in the present proceeding after the death of the petitioner, the writ petition stands dismissed for non-prosecution.
