¶1Heard Mr. S. M. Abdullah P, learned counsel for the petitioner Jiarul Haque. The petitioner has filed this application under Section 483 of the Bharatiya Page No.# 2/3 Nagarik Suraksha Sanhita, 2023 with prayer for bail as he is behind bars since

10.09.2024 in connection with Kaliabor P.S. Case No. 81/2024 registered under Section 303(2) of the BNS.

¶2Heard Mr. R. R. Kaushik, learned Additional Public Prosecutor, Assam for the respondent State.

¶3The allegation against the petitioner is that he has committed theft of 2 cows. It is submitted on behalf of the petitioner that the petitioner was forwarded to custody on suspicion. I have scrutinized the Forwarding report.

¶4I have considered the submissions at the Bar. It appears that bail may be granted to the petitioner.

¶5The petitioner shall be enlarged on bail on furnishing a bail bond of Rs.30,000/- (Rupees Thirty Thousand) with a suitable surety of like amount to the satisfaction of the learned SDJM, Kaliabor, under the conditions that:

(i) The petitioner shall refrain from such activities with which he is alleged,

(ii) The petitioner shall appear before the Investigating Officer on every fortnight till completion of investigation, and

(iii) The petitioner shall not leave the jurisdiction Page No.# 3/3 of the Court without prior permission.

¶6On breach of any of the bail conditions, bail order shall stand automatically cancelled.
