ORDER
16.02.2024
The instant writ petition has been filed on behalf of the petitioner seeking a direction upon the respondents to facilitate complete free treatment of the petitioner including the provision of all diagnostic facilities and medicines free of charges. It has been submitted by Mr. B Gogoi, the learned counsel appearing on behalf of the Health and Family Welfare Department that in pursuance to the order of this Court dated 11.05.2017, the petitioner has already been provided the said benefits. The learned counsel appearing on behalf of the petitioner, however, submits that the petitioner still continues to suffer on account of the disease. This Court has put a specific query upon the learned counsel for the petitioner as to whether the petitioner is a beneficiary of the Government of Page No.# 3/3 India Scheme i.e. Ayushman Bharat. The learned counsel for the petitioner submits that she has no instruction in that regard. Taking into account the above, this Court is of the opinion that if the petitioner wants to avail any benefit, the petitioner would be at liberty to claim the benefits under the Ayushman Bharat scheme subject to the petitioner falling within the eligibility. In that view of the matter, nothing further remains to be decided in the instant writ petition, for which the writ petition stands closed.
