ORDER Date : 27-09-2024 Heard Ms. T. Som, learned counsel for the petitioner namely, Rushikesh Kisan Shinde who has filed this application under Section 483 of the Bharatiya Page No.# 2/3 Nagarik Suraksha Sanhita, 2023 with prayer for bail as he is behind bars since

12.09.2024 in connection with Pathsala P.S. Case No.88/2024 under Section 304 BNS.

¶2Heard Mr. R.R. Kaushik, learned Additional Public Prosecutor, Assam for the respondent State.

¶3The petitioner was arrested in connection with a case of chain snatching. It is submitted on behalf of the petitioner that the petitioner believing the gold to be genuine purchased the gold from the miscreants, who have committed the offence of chain stanching. It is submitted that the petitioner is rather the victim than the aggressor.

¶4I have considered the length of detention and also scrutinized the case diary. The investigation of the case has progressed to a considerable extent. It appears that bail may be granted to the petitioner.

¶5Considering all aspects, I deem it proper to grant bail to the petitioner. The petitioner is enlarged on bail on furnishing a bail bond of Rs.30,000/- (Rupees Thirty Thousand) with two local sureties of the like amount to the satisfaction of the learned CJM, Pathsala, Bajali under the conditions that :

(i) the petitioner shall cooperate with the remaining part of investigation,

(ii) the petitioner shall refrain from such activities with which he alleged.

¶6On breach of any of the bail conditions, bail order shall automatically stand cancelled.

¶7In terms of the above observation, this Bail Application stands disposed of. Page No.# 3/3
