Md. Rahim Uddin v. The State of Assam

ORDER Date : 14.11.2024 Heard Mr. S. Gogoi, learned counsel appearing for the petitioner as well as Mr.RJ. Baruah, learned Additional P.P. for the State of Assam.

¶2This is an application filed under Section 483 of BNSS, 2023, whereby the petitioner Rohim Uddin has prayed for releasing him on bail, after he was arrested in Page No.# 2/2 connection with North Lakhimpur PS Case No. 247/2024.

¶3The allegation against the present petitioner is that from his premises 4.5 lakh of fake currency notes were recovered.

¶4Mr. Gogoi has submitted that the currency notes were not recovered from the possession of the petitioner. Rather, it was seized from a place within his premises and the said place was available for all other persons to use.

¶5Mr. Baruah that there are incriminating materials against the petitioner justifying his detention in custody. Mr. Baruah has referred to the case diary and submitted that the seized fake currency notes were recovered from the house of the present petitioner.

¶6I have considered the submissions made by the learned counsel of both sides.

¶7This Court if of the opinion that at this stage, the petitioner does not deserve to be released on bail. Therefore, his bail application stands dismissed and disposed of. The CD shall be returned.
