Nipu Kalita v. The State of Assam

ORDER 11-11-2024 Heard Mr. A. Choudhury, learned counsel for the petitioner and Ms. S. H. Borah, learned Additional Public Prosecutor, Assam for the State.

¶2Apprehending his arrest, the petitioner, namely, Nipu Kalita, son of Late Uday Chandra Kalita, resident of Jamtola Anchal, P.S.- Digboi, District-Tinsukia, has filed this application under Section 482 BNSS, 2023 seeking pre-arrest bail in Digboi P.S. Case No. 111/2024 corresponding to G.R. No. 310/2024 Page No.# 2/2 registered under Sections 78/351(2)/131/132/126(2)/74/3(5) of the BNS, 2023.

¶3Earlier, the Court by order dated 24.09.2024, while calling for the case diary of said Digboi P.S. Case No. 111/2024, granted interim bail to the petitioner, named above, in said Digboi P.S. Case No. 111/2024 and fixed the matter today.

¶4Today, during the deliberation of the matter, Ms. S.H. Borah, learned Additional Public Prosecutor, Assam on instruction, submitted that police after completion of investigation of the case has already submitted the charge-sheet in said Digboi P.S. Case No. 111/2024 vide Charge-Sheet No. 82/2024 dated

30.09.2024.

¶5In view of the above, the petitioner is directed to approach the appropriate forum/authority for his regular bail in said Digboi P.S. Case No. 111/2024 on or before 19.11.2024.

¶6Till then (i.e., 19.11.2024), the petitioner, namely, Nipu Kalita, shall remain on interim bail granted to him earlier on 24.09.2024 in said Digboi P.S. Case No. 111/2024.

¶7With the above observation and direction, this pre-arrest bail application stands disposed of.
