Judgment
ORDER
05.02.2024
None appears on behalf of the petitioner on call. Be that as it may, the instant writ petition has been filed being aggrieved by the investigation which was conducted by the Investigating Officer in respect of the Paltan Bazar Police Station Case No.1091/2011. It is the opinion of this Court that in view of the judgment of the Supreme Court in the case of Sakri Vasu Vs. State of UP, reported in (2008) 2 SCC 409, the instant writ petition is not maintainable. It has also been submitted by Mr. N Goswami, the learned counsel appearing on behalf of the respondent State, the said Paltan Bazar Police Station Case No.1091/2011 has already been transferred to Vishrantwadi Police Station, Pune, Maharastra. Under such circumstances, this Court finds no reason to entertain the instant writ petition and the same stands dismissed without prejudice to the criminal proceedings.
