24.04.2024. None appears for the petitioner on call. The grievance raised in this Writ Petition is for a direction to transfer the case to the CID, Assam to investigate the Hatigaon P.S. Case No.315/2015, registered under Section 420/406/423/468/34 of the IPC and also to take necessary steps to arrest the accused persons including the respondent No.6, namely, Dr. Md. Meraj Alam, Addl. Superintendent, Gauhati Medical College and Hospital. Mr. P. Deka, learned counsel appearing on behalf of the respondent No.6 submits that the aforesaid case has been culminated into a Final Report, which has been accepted by the learned Court five years back and no case is pending. Mr. K. Gogoi, learned Addl. Senior Government Advocate, Assam is present for the State. Having considered the submission of learned counsel for the respondent No.6 Page No.# 3/3 that the aforesaid Hatigaon P.S. Case No.315/2015 has been concluded logically in the form of submission of Final Report and the learned Court has also accepted the final report five years back, I find that there is no live issue to be determined by this Court. Accordingly, the Writ Petition stands closed.
