ORDER

12-11-2024 Heard Ms. S.G.Boruah, learned counsel for the petitioners and Mr. K.K.Das, learned Additional public Prosecutor, Assam for the respondent.

¶2The present application under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023, is filed by the petitioners, namely, (i) Montu Mili, (ii) Biswajit Mili, (iii) Nandaraj Mili,

(iv) Biswadhar Mili, and (v) Maniram Taye @ Bapuram Taye seeking pre-arrest bail apprehending their arrest in connection with Moranhat P.S. Case No. 36/2024, corresponding to GR Case No. 241/2024 registered under Sections 118(2)/109/115(2)/3(5) of BNS, 2023. Page No.# 3/3

¶3Perused the case diary.

¶4The witnesses have specifically implicated the accused petitioners in commission of offence.

¶5The medical report reveals that the nature of injuries of the victim is grievous.

¶6The case diary further reveals that the victim was hospitalized in Aditya Nursing Home, Dibrugarh for substantial period and he is now released from the hospital. However, the statement of the victim has not yet been recorded.

¶7In the totality of the matter and materials available, this Court is not inclined to grant interim bail to the petitioners named above.

¶8Accordingly, the present anticipatory bail application stands rejected.

¶9Case diary be returned back.
