Judgment

ORDER Date : 04.12.2024

Heard Ms. P. Kalita, learned counsel appearing for the petitioner and Mr. D. Das, learned Additional Public Prosecutor appearing for the State of Assam.

¶2This is an application under Section 482 of the BNSS, 2023 praying for grant of pre-arrest bail to the petitioner, Tafjul Ali in respect of Hajo P.S. Case No. 224/2024. Page No.# 2/2

¶3Pursuant to the interim order granted earlier by this Court, the petitioner has appeared before the Investigating Officer and his statement has already been recorded.

¶4Mr. Das has submitted that the deceased died because of fist blows and kicks.

¶5I have considered the submissions made by the learned counsels of both sides.

¶6This Court is of the opinion that since the petitioner has already appeared before the Investigating Officer and co-operated with police investigation, he does not deserve to be detained in custody because the case is yet to be proved in the trial.

¶7For that reason, the prayer for anticipatory bail is allowed.

¶8The interim bail granted earlier is hereby made absolute.

¶9With the aforesaid direction, the bail application stands disposed of. The CD shall be returned.
