Md Jalal Uddin v. The State of Assam

Heard Mr. S. Ahmed, learned counsel appearing for the petitioner and Mr. R.J. Baruah, learned Additional Public Prosecutor for the State of Assam.

¶2This is an application under Section 483 of BNSS, 2023 praying for grant of regular bail to the petitioner, Md. Jalal Uddin, who was arrested on 09.08.2024 in connection with Raha P.S. Case No. 102/2024. Page No.# 2/2

¶3On the day of occurrence, a group of miscreants stopped a truck at a place under the jurisdiction of Raha Police Station. The truck contained consignment of worth Rs. 30,00,000/-. After the incident, the truck was recovered in an abandoned condition, but the consignment was found missing.

¶4The police arrested one person and that person told that the stolen consignment was in the house of the present petitioner, but the consignment was not recovered from the house of the present petitioner.

¶5The petitioner has spent 57 days in judicial custody.

¶6I have considered the submissions made by the learned counsel for both sides.

¶7The bail prayer of the petitioner is allowed.

¶8It is hereby directed that the petitioner, Md. Jalal Uddin shall be released on bail of Rs.25,000/- with a surety of like amount to the satisfaction of the learned CJM, Nagaon.

¶9The bail application stands disposed of accordingly.

¶10Case diary shall be returned.
