Abhijit Bora v. The State of Assam

ORDER Date : 25.07.2024 Heard Ms. A. Bora, learned counsel for the petitioner. Also heard Mr. K. Baishya, learned Additional Public Prosecutor who produced an updated case diary as was directed by this Court by order dated 21.06.2024. The learned counsel for the petitioner has submitted that the petitioner was allowed to go on interim anticipatory bail by order dated 15.09.2023 by this Court and in pursuant to the directions of this Court, the petitioner has Page No.# 2/2 appeared before the Investigating Officer and has cooperated in the investigation. On the other hand, the learned Additional Public Prosecutor has submitted that on the perusal of the case diary, it appears that though the statement of the present petitioner has not been recorded by the Investigating Officer, however, he has appeared before the Investigating Officer and he was allowed to go on interim bail in pursuant to the directions of this Court. Considering the fact that substantial time has lapsed since the date of lodging of FIR and also considering the fact that the investigation has fairly progressed as well as the fact that the petitioner has complied with the directions of this Court, this Court is of considered opinion that, if he cooperates with the Investigating Officer, his custodial interrogation may not be necessary for fair completion of Dergaon P.S. Case No. 148/2023. Hence, the interim bail granted to the petitioner by order dated 15.09.2023 is hereby made absolute with condition Nos. 2 and 3 attached to the said order remaining intact. Accordingly, this anticipatory bail application is disposed of. Send back the case diary.
