ORDER Date : 07-02-2024 Heard Mr. G.G. Gogoi learned counsel for the petitioner and also heard the learned counsel for the respondent. The present application is filed alleging willful and deliberate violation of the order dated 15.12.2015 passed in WP(C) No.4671/2015. The direction issued in the aforesaid order is quoted herein below: "That being the position, court is of the view that the case of the petitioner for compassionate appointment is required to be reconsidered by the DLC,

to

the criteria/parameter laid down by this court in Achyut Ranjan Das (supra), more so, when vacancies were available. Accordingly, Deputy Commissioner, Lakhimpur is directed to once again place the case of the petitioner before the DLC, Lakhimpur for consideration in its next meeting."

The respondent Sumit Sattawan, IAS, District Commissioner, North Lakhimpur, Assam has filed an affidavit in opposition and annexed the District Level Committee (DLC) meeting report of Lakhimpur district for appointment on compassionate ground, held on 24.02.2017 in the conference hall of the District Commissioner, Lakhimpur. In the said meeting, the case of the petitioner was rejected on the ground that the Page No.# 3/3 proposal has spent its force. In that view of the matter and in the considered opinion of this court, the order has duly been complied with. Accordingly the contempt petition stands closed. It is needless to say that the petitioner is always at liberty to assail the decision made by the DLC, if so advised.
