ORDER
16.08.2024
Heard Mr. A Roshid, the learned counsel appearing on behalf of the petitioner. Mr. H Sarma, the learned Government Advocate appears for the respondent Nos.1, 2 and 3.
¶2The petitioner has approached this Court challenging a notice enclosed as Annexure-4 to the writ petition whereby the petitioner was asked to appear on
09.06.2016 at 11A.M., in the office of the Additional Deputy Commissioner, Bongaigaon in connection with an application filed for partition of the land described in the said notice.
¶3Taking into account the provisions of Section 99 of the Assam Land and Revenue Regulations, 1886, this Court finds no infirmity in the said notice enclosed as Annexure-4 to the writ petition.
¶4Accordingly, the instant writ petition is devoid of any merit for which the same stands dismissed. It is however, made clear that the petitioner would always be at liberty to file their objection(s), if the said partition proceedings had not yet been disposed of.
¶5Interim order, if any, stands vacated. JUDGE Comparing Assistant
