Heard Mr. M.U. Mondal, learned counsel for the applicant/petitioner. Also heard Ms. J. Sarma, learned CGC, Mr. J. Payeng, learned Standing Counsel, F.T., Ms. N. Bedi, learned counsel appearing on behalf of Ms. P. Baruah, learned Page No.# 3/4 Standing Counsel, ECI, and Mr. R. Talukdar, learned Government Advocate, Assam.

¶2The present application has been filed for extension of time for appearance of the applicant/petitioner before the Superintendent of Police (Border), Dhubri in view of the order dated 07.06.2024 passed in WP(C) No.5422/2017.

¶3By order dated 07.06.2024 passed in WP(C) No. 5422/2017, the petitioner was granted interim bail by this Court subject to the condition that the applicant/petitioner shall appear before the Superintendent of Police (B), Dhubri on or before 27.06.2024 etc.

¶4Learned counsel for the applicant/petitioner submits that the applicant was in Kerala at the time when the order dated 07.06.2024 in WP(C) No.5422/2017 was passed and he could not appear before the Superintendent of Police (B), Dhubri on time because the contractor under whom he was working at Kerala as a daily wage earner did not pay his daily wages.

¶5Learned Standing Counsel, FT has opposed the prayer made in the application on the ground that the extension of time is intended without producing any original particulars.

¶6Be that as it may, considering the explanation intended in the application, time to appear before the Superintendent of Police (B), Dhubri is extended till

14.10.2024 for the applicant and to comply with the directions contained in the order dated 07.06.2024 passed in WP(C) No.5422/2017.

¶7On appearance applicant within the extended time i.e. on or before

14.10.2017, the Superintendent of Police (B), Dhubri shall do the needful in terms of the directions contained in the order dated 07.06.2024 passed in Page No.# 4/4 WP(C) No.5422/2017.

¶8This order shall be read with the order dated 07.06.2024 passed in WP© No. 5422/2017.

¶9In view of the above, the Interlocutory Application stands allowed and disposed of.
