Mr. M. U. Mahmud, the learned counsel appearing on behalf of the Petitioner submits that the instant writ petition has become infructuous and as such he submits that he would not like to press the instant writ petition.

¶2On the other hand, the learned counsel appearing on behalf of the Respondent No.4 submits that the dispute between the Petitioner and the Respondent No.4 still remains as regards the non-payment of the amount to which the Respondent No.4 is entitled to. He further submits that only the case filed under Section 138 of the Negotiable Instruments Act, 1881 have been dismissed for non-prosecution.

¶3Taking into account the submission made by the learned counsel for the Petitioner who submits that he would not like to press the instant writ petition, the instant writ petition stands dismissed on withdrawal.

¶4Interim order passed earlier, stands vacated.
