Heard Mr. M Hussain, learned counsel for the petitioner and Mr. M P Goswami, learned Additional Public Prosecutor, Assam. This is an application filed under Section 483 of the BNSS, 2023 by the petitioner, namely, Page No.# 2/2 Nurjahan Begum @ Nuraj Begum, praying for release on bail, who was arrested in connection with Panbazar P.S. Case No. 219/2024. On the day of occurrence at night while a Police Patrolling Party was on duty and was searching for drug pedlar between the Lakhtokia Railway Gate Nos. 2 and 4, the Police were attacked by some persons causing injuries to the Police personnel. One person called Hidoy had snatched away the mobile phone of the informant along with some money, Aadhar Card as well as PAN Card. Mr. Hussain has submitted that the present petitioner was not present in that area on that day. Rather, she was in some other places. In order to buttress his argument, Mr. Hussain has filed a document also. Mr. Goswami has pointed out that the present petitioner has stated before Police that she was present at the place of occurrence at the relevant time. According to Mr. Goswami, the Police personnel sustained grievous injuries. I have considered the submission made by the learned counsel for both sides. This Court is of the opinion that the petitioner does not deserve to be released on bail at this stage. Therefore, the bail application of the petitioner is rejected. Accordingly, the bail application is dismissed and disposed of. Case Diary shall be returned.
