06.11.2024 Heard Mr. P J Dutta, learned counsel for the petitioners and Ms. S H Bora, learned Additional Public Prosecutor, Assam for the State. 2) By this application filed under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023, the petitioners, namely, (i) Debojit Das and (ii) Risu Das, are praying for their bail in connection with Geetanagar Police Station Case No. 178/2024 registered under Sections 61(2)/137(1)b/138 of the BNS,2023 read with Section 8 of the POCSO Act, in which, they were arrested on 07.09.2024 and are in custody since then. 3) During the deliberation of the matter, Ms S H Bora, learned Additional Public Prosecutor, Assam, on instruction, has submitted that police after completion of investigation of the case has already submitted charge-sheet in said Geetanagar Police Station Case No. 178/2024 vide charge-sheet No. 107/2024 dated 30.09.2024. 4) At this stage, Mr. P J Dutta, learned counsel, on instruction of the petitioners, submitted that the petitioners are not pressing this bail application stating that they will approach the appropriate forum for their regular bail in said Geetanagar Police Station Case No. 178/2024. 5) Accordingly, this bail application, being not pressed, stands dismissed.
