Miraj Ahmed and Anr v. The State of Assam

ORDER 04-11-2024 Heard Mr. A. B. T. Haque, learned counsel for the petitioners and Ms. S. H. Borah, learned Additional Public Prosecutor, Assam for the State.

¶2The petitioners, namely, (1) Sri Miraj Ahmed, son of Fakor Uddin and

(2) Sri Dilwar Hussain, son of Abdul Rakib, both resident of village – East Tangibari P.O. & P.S. – Ratabari under Karimganj District have filed this application under Section 482 of the BNSS, 2023 seeking pre-arrest bail apprehending their arrest in Silchar P.S. Case No. 605/2024 registered under Section 61(2)/329(4)/319(2)/318(4) of the BNS, 2023, read with Section 10(1) of the Public Examination (Prevention of Unfair Means), Act, 2024.

¶3Earlier, the Court by order dated 08.10.2024, while calling for the case diary of said Silchar P.S. Case No. 605/2024, granted interim bail to the petitioners, named above, in said Silchar P.S. Case No. 605/2024, fixing the matter today.

¶4During the deliberation of the matter, Ms. S. H. Borah, learned Additional Public Prosecutor, Assam on instruction, submitted that police after completion of investigation of the case has already submitted the charge-sheet in said Silchar P.S. Case No. 605/2024 vide Charge-Sheet No. 916/2024 dated

19.10.2024.

¶5In view of the above, the petitioners are directed to appear before the appropriate forum/authority for their regular bail in said Silchar P.S. Case No. Page No.# 3/3 605/2024 on or before 18.11.2024.

¶6Till then (i.e., 18.11.2024), the petitioners shall remain on interim bail granted to them earlier on 08.10.2024 in said Silchar P.S. Case No. 605/2024.

¶7With the above observation and direction, this pre-arrest bail application stands disposed of.
