13/11/2024 No representation on behalf of the petitioners on call, though names of three counsels have been reflected in the cause list. Heard Ms. S H Bora, learned Additional Public Prosecutor, Assam for the State respondent. This application under Section 483 BNSS, 2023 has been filed by the petitioners, namely, (1) Dilowar Hussain, son of Atik Ullah, resident of Colony Jalah, P.S. Juria, District-Nagaon, (2) Halimuddin Barbhuiyan, son of Lt. Amirudding Barbhuiyan, resident of Natun Ram Nagar Part-IV, P.S. Sonai, District-Cachar, (3) Altab Hussain, son of Kholilur Rahman, resident of Sarke Basti, P.S. Lumding, District-Hojai, seeking bail in Numaligarh Rural P.S. Case No. 30/2024 registered under Section 21(c)/29 of the Narcotic Drugs and Psychotropic Substances Act, 1985 corresponding to G.R. No. 271/2024, wherein they were arrested on 02.06.2024 and are in custody since then. During the deliberation of the matter, Ms. Bora, learned Additional Public Prosecutor, Assam, on instructions submitted that police after completion of investigation of the case has already submitted charge-sheet in the said Numaligarh Rural P.S. Case No. 30/2024 vide Charge-Sheet No. 53/2024 dated 31.10.2024. In view of the above, the petitioners may approach the appropriate forum for their regular bail in said Numaligarh Rural P.S. Case No. 30/2024. With the above observation and direction, this bail application stands disposed of.
