Heard Mr. R. Singha, learned counsel for the petitioner as well Mr. B.D. Das, learned Senior Counsel for the respondent nos.5 & 6 assisted by Ms. R. Deka, learned counsel. Mr. K. Gogoi, learned counsel appears for the respondent nos.1, 2, 3, 4 & 7. The petitioner's counsel submits that though the petitioner had made a challenge to certain conditions in the NIT dated 23.09.2024 and though this Court had given an interim order on 08.10.2024 that the Technical Bid should not be opened today, the petitioner has participated in the tender process, by submitting his tender documents. He accordingly submits that the said action of the petitioner has resulted in the writ petition becoming infructuous. In view of the submission made by the petitioner's counsel, the writ petition is dismissed as infructuous.
