Hrishikesh Baruah v. The State of Assam

Heard Mr. I H Barbhuiya, learned counsel for the petitioner and Mr. R J Baruah, learned Additional Public Prosecutor, Assam. This is an application filed under Section 483 of the BNSS, 2023 by the petitioner, namely, Hrishikesh Baruah, praying for release on bail, who was arrested in connection with Hatigaon P.S. Case No. 216/2024. The allegation brought against the petitioner is that he was pretended to be an officer of Page No.# 2/2 ALFRESCO Solution Centre and after that he took an amount of Rs. 2,20,000/- from the informant in lieu of supplying 70 nos. of woman workers to his industry. Later, it was discovered that the petitioner is not an official of ALFRESCO Solution Centre. I have considered the submission made by the learned counsel for both sides. This Court is of the opinion that the petitioner does not deserve to be released on bail at this stage as there are sufficient incriminating materials against him. Therefore, the bail application of the petitioner is rejected. Accordingly, the bail application is dismissed and disposed of. Case Diary shall be returned.
