¶1Heard Mr. F. Haque, learned counsel for the petitioner Karijul Haque.

¶2The petitioner has filed this application under Section 439 of the Code of Criminal Procedure (CrPC for short) as he was forwarded to custody on

27.08.2023 in connection with Dhing Police Station Case No. 148/2023 Page No.# 2/2 under Sections 22(c)/29 of the Narcotic Drugs and Psychotropic Substances Act, 1985.

¶3The FIR unfolds that the petitioner was caught carrying 18 (eighteen) bottles of codeine phosphate syrup by the investigating agency.

¶4Heard Mr. B.B. Gogoi, learned Additional Public Prosecutor for the respondent State of Assam. The FSL report has been forwarded along with the case diary.

¶5I have perused the case diary.

¶6The FSL report reveals that the seized articles have a negative report for narcotic drugs and psychotropic substances. Considering the negative FSL report, the petitioner, who has been behind bars for 145 (One Hundred Forty Five) days, is released on bail on furnishing a bail bond of Rs.50,000/- (Rupees Fifty Thousand) with a suitable surety of like amount to the satisfaction of the learned Special Judge, Nagaon. The learned Special Judge may impose conditions which the Court deems fit and proper.

¶8In the above terms and conditions bail application stands disposed of.
