School was a temporary arrangement to be understood that upon the regular Head Teacher returning back to service after completing the leave period is entitled to a legal right to be restored with her duties as the In-Charge Head Teacher and since the same was not done, this writ petition was filed by the petitioner. The Court while issuing the said order dated 11.10.2023 found that the petitioner could make out a prima facie case therefore, stayed the order Page No.# 5/7 dated 06.12.2022, issued by the Deputy Inspector of Schools, Barpeta by which the respondent No.8 was allowed to serve as the In-Charge Head Teacher of said 617 No. Kayastha Gaon Tribal L. P. School, observing that if the respondent authorities, particularly, the Deputy Inspector of Schools, Barpeta is of the view that the School requires an In-Charge Head Teacher for smooth functioning of the School, then it shall look into the aspect as to why the petitioner being the earlier Head Teacher upon returning back to her duties should not be allowed to resume her duties and directed to pass appropriate order accordingly. 9) Inspite of the said order dated 11.10.2023, of the Court the respondent authorities, particularly, the Deputy Inspector of Schools, Barpeta till date did not pass any order. 10) Mr. Ali, learned counsel for the respondent No. 8 on being enquired submitted that in pursuance of the approval of the State Government vide letter dated 26.03.2013, the Director of Elementary Education, Assam by order under No. EE(Plan)-Provn/L.P./Provn/Barpeta/332/2013/55 dated 14.05.2013 provincialised the services of the respondent No.8 w.e.f., 01.01.2013 as an Assistant Teacher of Kamaragaon Lower Primary School under Gobordhana Education Block of Barpeta district as per the provisions of The Assam Venture Educational Institutions (Provincialisation of Services) Act, 2011, as amended in 2012 during its force. 11) To that extent, Mr. Ali, learned counsel for the respondent No.8 also placed a copy of the provincialisation order of the respondent No.8 dated
