Heard S H Sikdar, learned counsel for the petitioner and Mr. R R Kaushik, learned Additional Public Prosecutor, Assam. This is an application filed under Section 483 of the BNSS, 2023 by the petitioner, namely, Sri Lakhya Deka @ Sri Lakhyadhar Deka, praying for release on bail, who was arrested in connection with Kamalpur P.S. Case No. 156/2024. Page No.# 2/2 The allegation made in the FIR is that the wife of the informant was maintaining illicit relationship with the present petitioner. The informant has alleged that on

27.04.2024 his wife has left is accompany and started living with the present petitioner in another house. Thereafter, the informant took some media personnel with him to the house where his wife was living with the petitioner. People were also gathered there and handed over the petitioner to Police. The informant has further alleged that his wife had taken an amount of Rs.9,00,000/- from the account of his minor daughter. Mr. Sikdar further submits that a divorce proceeding is also going on between the parties in the Family Court and the husband now wanted to create a good ground for getting divorce. The petitioner has already spent 14 [fourteen] days in custody. Having heard the learned counsel of both sides, this court is of the opinion that the petitioner does not deserve to be detained in custody for further period of time. Hence, the bail application of the petitioner is allowed. Accordingly, it is hereby directed that the petitioner Sri Lakhya Deka @ Sri Lakhyadhar Deka, who was arrested in connection with Kamalpur P.S. Case No. 156/2024, shall be released on bail of Rs.25,000/- with one surety of like amount to the satisfaction of the learned SDJM, Rangia. The bail application is disposed of.
