ORDER

25.10.2024

Heard Mr. N Uddin, learned counsel for the petitioner and Mr. R J Baruah, learned Additional Public Prosecutor, Assam. This is an application filed under Section 483 of the BNSS,2023 by the petitioner, namely, Md. Hasibul Islam, praying for release on bail, who was arrested in connection with Narayanpur P.S. Case No. 43/2024. Page No.# 2/2 The informant, by filing an FIR, has alleged that the petitioner along with two other persons offered him to sell fake gold and demanded Rs.15 lakhs in exchange of that gold. But, when the informant wanted to examine the gold, the petitioner and the other persons fled away. The petitioner has already completed 58 [fifty-eight] days in custody. I have considered the submissions made by the learned counsel of both sides. Considering the period of detention, already undergone by the petitioner and also considering the fact that the petitioner only attempted to commit an offence, the bail prayer of the petitioner is allowed. Accordingly, it is directed that the petitioner, Md. Hasibul Islam, who was arrested in connection with Narayanpur P.S. Case No. 43/2024, shall be released on bail of Rs.20,000/- with one surety of like amount to the satisfaction of the learned Chief Judicial Magistrate, Lakhimpur, North Lakhimpur. The bail application is disposed of.
