Eunus Ali v. The State of Assam and Anr

ORDER 12-11-2024 Heard Mr. J. Ahmed, learned counsel for the petitioner and Mr. B. Sarma, learned Additional Public Prosecutor, Assam for the State.

¶2By this application filed under Section 483 BNSS, 2023, the petitioner, namely, Eunus Ali, son of Late Surhab Ali, resident of Village-Chetuaikhaity, P.S.-Laharighat, District-Morigaon is seeking bail in Laharighat P.S. Case No. 182/2024 corresponding to G.R. No. 1085/2024, registered under Sections 61(2)/96/65(1)/296/ 115(2)/3(5) of the BNS, 2023, read with Section 4 of the POCSO Act, wherein, he was arrested on 29.09.2024 and in custody since then.

¶3On instruction of the petitioner, Mr. Ahmed, learned counsel submitted that police after completion of investigation of the case have already submitted the charge-sheet in said Laharighat P.S. Case No. 182/2024 and that the petitioner shall approach the appropriate forum for his bail in said Laharighat P.S. Case No. 182/2024. As such, Mr. Ahmed, learned counsel prays for withdrawal of this bail application, to which the learned Additional Public Prosecutor, Assam has no objection.

¶4Prayer is allowed.

¶5Accordingly, this bail application stands dismissed, as not pressed.
