These two bail applications have taken up for consideration together as the cause of action of the cases arose out of the same FIR. Heard Mr. S.A. Ahmed, learned counsel for the petitioner in BA No. 3322/2024 and Mr. S Islam, learned counsel for the petitioner in BA No. 3292/2024. By filing the Bail Application No. 3322/2024, the petitioner Jahirul Kha @ Jehirul Kha and the petitioner in Bail Application No. 3292/2024, namely, Abirchan Ali @ Abir Chand Ali, who were arrested in connection with Barpeta Road P.S. Case No. 131/2024, have prayed for release on bail. It is submitted that today is the 91st day in judicial custody of the petitioners. The learned Additional Public Prosecutor has submitted that no charge sheet has been submitted till now. For the aforesaid reasons, these two petitioners are entitled to default bail. Therefore, the bail prayers of the petitioners are allowed. Accordingly, it is directed that the petitioners, Jahirul Kha @ Jehirul Kha and Abirchan Ali @ Abir Chand Ali, who were arrested in connection with Barpeta Road P.S. Case No. 131/2024 shall be released on bail of Rs.20,000/- each with one surety of like amount to the satisfaction of the learned Chief Judicial Magistrate, Barpeta. The bail applications are disposed of. Case diary shall be returned.
