¶2This an application 482 of the BNSS, 2023, whereby the petitioner has prayed for grant of pre-arrest bail in respect of Halem P.S. Case No. 63/2024.

¶3The petitioners are employees of North East Small Finance Bank. It is alleged in the FIR that they had transferred money from the savings account of customers to their loan account. But, subsequently, the petitioners again refunded the money from their loan account to the savings account of customers. The case diary also supported the fact.

¶4I have considered the submissions made by the learned counsels of both sides.

¶5This Court is of the opinion that for the aforesaid reasons, the petitioners do not deserve to be detained in custody. Accordingly, their anticipatory bail application is allowed.

¶6It is hereby directed that in the event of arrest in connection with Halem P.S. Case No. 63/2024, the petitioners, Jintu Gogoi and Prabitra Lahon shall be released on bail of Rs. 20,000/- each with sureties of like amount to the satisfaction of the arresting authority.

¶7The petitioners are directed to co-operate with the Investigating Officer as and when required.

¶8With the aforesaid direction, the bail application stands disposed of.
